New Mexico's official FAQ says the law passed in the 2025 legislative session, was signed in April 2025, and the Department of Health is targeting first patient enrollment by the end of December 2026. The program page also describes implementation work through December 31, 2027.
DOH rules, advisory-board work, clinician permits, producer and lab standards, patient enrollment dates, and qualifying-condition guidance.
Do not treat New Mexico as Colorado-style personal possession, home cultivation, retail sales, or active public service-center access.

Medical Program Buildout — Target First Patients Dec. 2026
The Medical Psilocybin Act passed during the 2025 legislative session and was signed by Governor Michelle Lujan Grisham in April 2025. The New Mexico Department of Health is developing rules and says the program goal is enrolling first patients by the end of December 2026. Medical use does not begin until rules are complete and in effect.

SB 219 / Medical Psilocybin Act (2025) created a regulated medical psilocybin program for qualifying conditions including treatment-resistant depression, PTSD, substance use disorders, and end-of-life care. The law keeps psilocybin federally illegal and does not create Colorado-style personal possession or home cultivation.
Therapeutic Programs
New Mexico's program is in Department of Health rulemaking and implementation as of May 2026. DOH guidance says natural psilocybin from mushrooms is the core program substance and the first-patient enrollment target is the end of December 2026. Verify current DOH rules before relying on any provider claiming active New Mexico access.
